Will Trump Testify?

The president's lawyers are looking for ways to avoid him talking to Special Counsel Robert Mueller.

President Donald Trump's legal team is getting ready for the possibility of his having to testify before Special Counsel Robert Mueller's Russia probe. Not surprisingly, team Trump is reportedly looking for ways to minimize his exposure or avoid testimony altogether.

Per NBC News:

Anticipating that Special Counsel Robert Mueller will ask to interview President Donald Trump, the president's legal team is discussing a range of potential options for the format, including written responses to questions in lieu of a formal sit-down, according to three people familiar with the matter.

In addition to the possibility of suggesting the president submit written responses in place of an interview, a second person familiar with the president's legal strategy said another possibility being contemplated was an affidavit signed by the president affirming he was innocent of any wrongdoing and denying any collusion.

A signed affidavit? Seriously? Trump should not be permitted to duck real testimony with written answers or an affidavit.

The report also notes that "Trump's legal team has been debating whether it would be possible to simply avoid" his having to speak to Mueller at all.

On one hand the idea of Trump testifying should not qualify as news: Back in June Trump said that he was "100 percent" willing to talk to Mueller, specifically about his firing of FBI Director James Comey. But of course Trump says a lot of things, many of which are unrelated to the truth.

Given both that serial mendacity and the growing questions about his mental state, the idea of Trump speaking to Mueller is fascinating and, for him, fraught.

One big reason Trump's lawyers may wish to avoid having him testify is the fact that he fabricates constantly. The Washington Post found that he made 1,950 "false or misleading claims" as president during 2017; PolitiFact has rated nearly 500 of his public utterances over the years and found 70 percent to be "mostly false," "false" or "pants on fire." And if you think that the fact of cooperating with an investigation, whether under oath or simply chatting, would make Trump less liable to lie, recall that he has testified under oath numerous times seemingly without curbing his penchant for making things up.

I'm old enough to remember when Republicans thought that the mere fact of lying to a special counsel was an impeachable offense. They would undoubtedly adopt a more forgiving posture if Trump testified before Mueller, but why would Trump and his aides want to take the chance? Newsweek's Kurt Eichenwald reviewed his testimony under oath from over the years and concluded: "Either he consistently lies when under oath or his inability to recognize the truth is a symptom of a psychiatric disorder."

And that leads us to another optics problem Team Trump has to consider as they figure out whether and how to respond to a request for testimony.

Michael Wolff's controversial bombshell "Fire and Fury" has given new life to questions about Trump's mental health, especially whether the 71-year old is starting to suffer some sort of dementia. "Everybody was painfully aware of the increasing pace of his repetitions," Wolff writes. "It used to be inside of 30 minutes he'd repeat, word-for-word and expression-for-expression, the same three stories – now it was within 10 minutes. Indeed, many of his tweets were the product of his repetitions – he just couldn't stop saying something."

The uptick in questions about his mental capacity to handle his job prompted the president over the weekend to announce over Twitter that not only was he "like, really smart" but also "a very stable genius." (Because who but a "stable genius" would issue such a tweet?)

In the same tweet-storm he also compared himself favorably to Republican icon Ronald Reagan, complaining that the media also leveled charges of "mental instability and intelligence" or lack thereof against the Gipper. Of course Reagan may not be the best example for Trump to proffer, given that, as Trump may recall, he did develop Alzheimer's and his son later said he thought he was indeed showing signs of it while in office.

Trump avoiding actually speaking to Mueller or any of his team or, short of that, trying to do it in as controlled a setting as possible, could feed the incapacity narrative: If he's looping every 10 minutes they don't want it dramatically disclosed in testimony. Better to have him give answers in writing or not at all.

So what's actually likely to happen? It seems a fair bet that Mueller will want to interview Trump personally. It also seems pretty sure that if they're unable to squirm out of it with – ha ha – an affidavit or written answers, Trump's lawyers won't let him appear on camera or otherwise recorded.

There are a couple of precedents here worth noting. When Bill Clinton testified before Kenneth Starr's independent probe, he did so on camera, video which was subsequently released; Ronald Reagan spoke to the Tower Commission, which he had created, twice for a total of 145 minutes and did so with note-takers present but no recordings.

That's another reason it was a bad idea for Trump to invoke Reagan: The Gipper spoke to investigators at length, twice.

Don't hold your breath waiting on Trump to do anything like that.

NOTE:  Don't know about you, but I can't wait until Trump testifies.  I mean what I wouldn't give to be a fly on the wall in Mueller's interrogation room.  Donald Trump is so dumb I'm sure he thinks that he'll just breeze through answering Bob's questions, saying whatever the hell pops into his mind and breezily making shit up just like he does every day as President.  It will be curtains for him.  And I think his attorneys will know it.  Which is why I don't think he will every testify in person.  Some other arrangements will be made.  But I'm sure they will fail too!
